Propunem soluții juridice pentru insolvență. Insolvența este definită în Legea nr. 85/2014 ca fiind starea patrimoniului datoratului care se caracterizează prin insuficiența fondurilor bănești disponibile pentru plata datoriilor certe, lichide și cele care pot fi cerute îndată de către creditor. Adică, ea există atunci când o societate nu își mai poate plăti datoriile.

1. Procedura generală este procedura de insolvență prin care un debitor intră, după perioada de observație, succesiv, în procedura de reorganizare judiciară și în procedura falimentului sau separat, doar în reorganizarea judiciară, ori doar în procedura falimentului.

2. Procedura simplificată este procedura de insolvență prevazută de Legea nr. 85/2014 prin care  debitorul care îndeplinește condițiile prevăzute la art. 38 alin. (2) intră direct în procedura  falimentului, fie odată cu deschiderea procedurii insolvenței, fie după o perioadă de observație de maximum 20 de zile.

3. Procedura reorganizării judiciare este acea modalitate de realizare a procedurii insolvenței ce se aplică debitorului, persoană juridică, în vederea achitării datoriilor acestuia, respectând programul de plată a creanțelor

4. Procedura falimentului este acea procedură de insolvență care se aplică debitorului în vederea lichidării averii acestuia pentru acoperirea pasivului, fiind urmată de radierea debitorului din registrul în care este înmatriculat.
